Opening Statement for State V. John Hudson and Dale Buckner

Case #1 State v. John Hudson and Dale Buckner (Charged with murder and attempted robbery) Good Afternoon Ladies and Gentleman†¦Todays trial will be on Felony Murder and Attempted Robbery. John Hudson and Dale Buckner are murderers. And the evidence of this case will show, that they have undoubtedly committed the crimes brought upon them and should be punished to the fullest extent of the law.In accordance to the Penal Law, Murder in the first degree is defined â€Å"With intent to cause the death of another person, he causes the death of such person†¦ the victim was killed while the defendant was in the course of committing / attempting to commit in furtherance of robbery [or other such felonies. ]{ §125. 27(1)(a)(vii)}† This is also known as Felony Murder. Robbery is also defined as forcible stealing. On February 14th 2011 in a small clothing store owned and managed by Sidney and Sara Lazar, a very heinous crime was committed.Two average looking men wearing black leather jackets entered the store at approximately 3:15 pm, later to be â€Å"proven† to be John Hudson and Dale Buckner. When approaching the counter with a . 38 revolver in hand, the defendant demanded all of the money from the register. As the other man stood point at the entrance to the store. Mrs. Lazar let out a scream, produced from shear fear for her life. In doing so, Dale Bruckner responded â€Å"Shut her up Johnny† which resulted in Mrs. Lazar being brutally shot in the head, dreadfully causing death on impact.Soon after the gun went off, the two men fled the store and took off in a black Cadillac sedan. This left a deceased woman and her innocent husband at the scene of the crime in a pool of blood. Five minutes later Officer Reilly arrived on the scene and accessed the situation. With diligent research and a thorough investigation, the arrest of the defendants was reinforced by the owner ship of a . 38 caliber pistol, a newly registered black Cadillac Seda n as well as a previous criminal record from both of the defendants. I will call the prosecution’s witness Mr.Sidney Lazar to the witness stand to divulge the utter gruesome details of how his wife was shot in cold blood, in front of his very own eyes. I will also call to testify the prosecution’s witness and innocent bystander Richard Green to the witness stand. He will help us positively identify the defendants, and reinforce that the defendants did in fact commit the crimes charged, as he was the only eye witness that saw the defendants leave the scene of the crime. These two men witnessed the crime take place and are testifying that the two defendants did in fact kill Mrs.Lazar. Investigator Sam Reilly will also be called to testify, in that he was the first investigator on the scene. Shortly after the murder, Officer Reilly went to the defendant’s home at 2435 Damen Street, apt #2B and forced down Mr. John Hudsons’ and Dale Buckner’s door. Whi le at the apartment, Officer Reilly Recovered a . 38 revolver (matching the gun from the crime scene), a black leather jacket, and a newly registered Black Cadillac Sedan; which matched the description of the getaway car.Due to officer Reilly’s work, pertinent details of the defendant’s background and belongings have been brought to trial and will help us prove that the defendants did, beyond a reasonable doubt murder, and assist in murdering Mrs. Sara Lazar. Upon arrest, the defendant’s both refused to make a statement concerning the killing of Mrs. Lazar. Ladies and Gentleman, the defense; John Hudson and Dale Buckner claim that they were not at the scene of the crime on the fourteenth of February at approximately 3:15 pm.Conveniently two months after the incident, William Barr was interviewed by Investigator Albert LaRue and swore that he saw the defendants at â€Å"Sam’s Chicken Shack† at about 3:15 on the day of the murder. He failed to mentio n this until two months later. His failure to be expeditious about his alibi just proves his minute acquaintance to the defendant’s. Although Mr. Barr might not have a previous criminal record, he is blinded to the lack of moral aptitude held by the defendants here today. In addition to Mr.Barr’s testimony, a Pathologist will testify and will help us better understand the cause of death, of Mrs. Lazar. As well as a ballistic expert, will attest to the knowledge of the weapon used in this murder case and will help us verify that the . 38 caliber pistol was in fact the murder weapon of this case. In the course of this trial I will demonstrate that these two defendants did in fact commit the crime of murder and attempted robbery. The lack of morality expressed by the defendant’s actions will assist us in concluding with a verdict of guilty for these two men.I expect to prove that without a doubt these two men are in fact murderers. Those who perform such crimes wit h intent to kill someone, men of distaste, and men of disgust, men who lack a conscience, and can kill an innocent woman deliberately with no remorse. Once again, these men are dangerous; we must prove today that the evidence brought upon us will show in its entirety that John Hudson and Dale Buckner committed the crimes before them. These two men must face ramifications and should go to jail forever. Mr. Hudson’s previous conviction of aggravated assault and Mr.Buckner’s previous conviction of theft go hand in hand. Their previous crimes make a perfect match for the situation imminent. They will be punished and Mrs. Lazar’s death will not go overlooked. Ladies and gentlemen of the jury let me ask you, would you be able to sleep at night knowing that these two men are on the streets, and have the ability to commit such a crime once more? Would you feel safe having your kids walk to the ice cream store knowing that these killers could possibly be around the corne r just waiting for their opportunity to strike again?These men must be taught a lesson now, so these streets can be kept safe for the ones we love. A person forcibly steals property and commits robbery when, in the course of committing a larceny, he uses or threatens the immediate use of physical force upon another person for the purpose of: Preventing or overcoming resistance to the taking of the property or to the retention thereof immediately after the taking; or Compelling the owner of such property or another person to deliver up the property or to engage in other conduct which aids in the commission of the larceny. Murder -A person is guilty of murder in the first degree when: -With intent to cause the death of another person, he causes the death of such person or of a third person; and -the victim was killed while the defendant was in the course of committing or attempting to commit and in furtherance of robbery, †¢Homicide The deliberate and unlawful killing of one person by another; murder.

Is there a pay differential between whites and blacks? Essay

Forty-five years ago, President Kennedy signed the Equal Pay Act into law, by pronouncing it unauthorized and illegal to pay African Americans and whites employed in the same work place different wages for the same exact equal work. The ratio of whites to African Americans average pay was 58 percent on an annually income. According to the Lexicon Universal Encyclopedia, wage differential is the difference in wage rates between two types of workers. Wage differential is very common in our society today. Researchers have concluded that wage differential only exists in certain demographic areas, based on race and gender. There is a common prophecy that men earn more earnings than women, and whites earn more earnings than African Americans. According to MSN. com, discrimination is different treatments of others based solely on their membership in a socially distinct group or category, such as race, ethnicity, religion, age or disability. Also, discrimination is an unfair act with compelling force, which is commonly known throughout society. Unlawful discrimination is related to the mistreatment of others. Due to discrimination occurring in the work place, African American employees are being shortchanged on their wages for doing the same job that whites are doing and are earning more earnings than African Americans. Researchers have found out that this has happened and is still occurring in jobs today, and therefore the government will have to make an intervention to displace discriminatory acts in businesses. Using data from a 2006 Survey of Income and Discrimination Participation, researchers were able to come up with the fact that there is a 62 percent difference in the wages that are offered to African Americans. Labor curves are sloping upwards and this means that wage discrimination against African Americans sometimes reduce not just their percentage wage but also their percentage of employment rates. The difference in average pay between African Americans and whites are a result of the labor market. The characteristics that African Americans and whites bring are totally different resulting in different wages. Some jobs discriminate against African Americans by employers and co-workers who would rather prefer whites. There are jobs that prefer white males only to do manual and physical labor, but you have African Americans in a white male only field ready to take on the work and try and do a better job at it. II. IDENTIFYING THE ISSUES According to the BlackCommentator Magazine, it says that there are two common excuses for wage racial inequality and that is age and geographic location. Racial wage plays a part in inequality due to the fact that African Americans are younger than whites. So therefore younger African American will take a lower pay than older whites. Dealing with the geographic area of African Americans; African Americans mostly reside in the South. The South is known for its low paying jobs and whites have acquired this knowledge and decided to move North in an effort to find better jobs and better knowledge. African Americans are obtaining the skills that whites have acquired and are really becoming similar, the only problem is that whites are getting paid more and this is a result of a significant gender wage gap. Public policy in the United States has aimed at improving and equalizing opportunities for African Americans. According to â€Å"Explaining Trends in the Gender Wage Gap† a report by The Council of Economic Advisors, it estimates that whites were over paid and that African Americans were under paid by at least 60 percent in the mid 1950s. In the 1970s, the ratio began to rise, and in the mid 1990s, the gender wage pay began to rise even more again reaching more than 75 percent. The gender wage gap can be revisited to an unexplained part in society that may be due to African Americans low labor market skills. Reduced gender wage gap for African Americans has contaminated our society today. If African Americans would invest in more labor skills and education, then the gender wage gap will make an increasing hike. Researchers have attempted to retrieve evidence on the gender wage gap. Economists have known that African Americans and whites wages are determined on the combining of the employer and employee status. Needless to mention on the two interact with one another. Understanding the establishment of wage differentials is determined by how important the labor market theories are of the environment. The magnitude of how this affects the labor market is tremendously understated. According to www. clinton4. nara. gov, the U. S. The wealth gap among African Americans and whites is just not based on income. Wealth gaps came about in the 1960s and hit the African American society really hard. Earning gaps respond at all levels of education; even when the levels of education and work experience are the same between African Americans and whites. The racial gap consistently remains between 10 to 20 percent, and the racial gap does not necessarily reflect discrimination, but mostly it observes the labor market that has segmented into two races. The whites are continuing to receive an advantage in the segmented markets over equally qualified blacks. The wealth gap is at the core of many socioeconomic differences that have persisted during the post dramatic era. Closing the racial wealth gap will be an extreme challenge to face in the years to come. According to Kenneth Crouch, an Associate Professor of Economics says that the distribution of African Americans wages have become more like that of white, yet the considerable process has yet to be made before there can be such a word called equal among African Americans and whites. There is a visibility between African Americans and whites in fringe benefits due to the total compensation with a percentage of nearly 40 percent. The benefit level depends on the income of African Americans and whites for adequate health pensions and a successful retirement. Fringe benefits are a big part of life and will come in handy when needed most. During the recent years, African Americans and whites non-wage compensation had increased more than wages and salaries. It was also contemplated that fringe benefits had no serious biases which resulted from the neglect of salaries and wages. Human capital is the attributes of a person that is productive in some economic context such as a stock of productive skills and or technical knowledge embodied in labor. Many early economic theories refer to it simply as labor, one of three factors of production, and consider it to be a tangible resource — homogeneous and easily interchangeable. It often refers to formal educational attainment, with the implication that education is investment whose returns are in the form of wage, salary, or other compensation. These are normally measured and conceived of, as private returns to the individual but can also be social returns. Human capital is often viewed as the most important determinant of wages. Human capital may come in different forms such as, schooling, training courses, honesty, and lectures therefore human capital like this will most likely raise earnings in today’ society. People cannot be separated from knowledge, health, or values that they may have acquired through human capital. According to Harvard economists, Richard Freeman, he wrote The Overeducated American, and this caused a huge downfall to investments in human capital. This made people come to a realization that maybe education, training, and investments really did not raise productivity or raise earnings. The economy of human capital has brought about a dramatic change in the lives of African Americans. III. DATA (TRENDS IN THE BLACK-WHITE WAGE GAP) The wage gaps between African Americans and whites are largely determined by educational disparities and occupational differences. There is evidence that African Americans fall short on wages due to the relative wage median. A government study finds that the African American wage gap in employment and earnings reduces when educational achievement levels are advanced. There are some mere facts that go along with the wage differential of African Americans and whites: †¢Whites continue to receive substantial privileges and preferences than African Americans †¢The argument that racial wage gap merely reflects different levels of qualifications and experience between African Americans and whites is simply unattainable. †¢African Americans test scores and other academic achievements is different and the whites test scores account for at least 17 percent of the wage gaps †¢African Americans median incomes are presented in every region and are lower than median incomes for whites †¢African Americans lack the natural resources that are need in order to better themselves and receive an attainable education. On average African American workers also have less education than white workers and are more likely to work in lower paying occupations. Depending if African American employees have the same education as white workers, African Americans relative wages would only improve by only a few cents on every dollar. The growing disparities of wage gaps are likely to be persistent, educated, and well skilled workers. Education and training are the most important investments in human capital. Education and work experience play a major part in expanding the career percentage. Education and work experience can account for about one half of the racial wage gap. Education is a very distinctive part of what your income is based on. It depends on your educational level and how far you chose to go in your education process. It is highly important to grace your presence with some kind of college degree, so that you will have something to fall back on. A higher education is a positive for human capital. Some African American men and women lack the knowledge to know when it’s okay to come up and outshine others because you want more in life than the next person. There has been a vast improvement since the 1980s in African Americans attending college to advance their career to get the same career wage percentage as whites. African Americans tend to sideline to other occupations that may fit into their perspective and that lets others realize, who may be afraid to come up and that’s basically called occupational segregation. Occupational segregation is the concentration of men and women in different kinds of job, as where the workforce of a particular industry or sector is mostly made up of one particular gender. Occupational segregation is one of the main reasons for the gender gap wage gap between men and women. For African American men and women working full-time it is currently 45% of that group receiving unfair wages compared to whites. According to â€Å"Gender Inequality and Difference,† occupational segregation has been concluded into many debates about gender. The causes of occupational segregation are gender bias based on stereotypical, biological and social differences between men and women. Occupational segregation problems arise when these stereotypes are used subconsciously to prejudge a person’s ability and competence such as a woman is emotional and caring, and a man is aggressive and competitive. Levels of occupational segregation are held responsible for the discrepancy between African Americans and whites among wage differential. Occupational segregation is basically another form of discrimination. The analysis of the changes that has influenced the occupational segregation on African Americans earning’s should clarify the mechanisms that maintain the gender inequality in the labor market. According to the National Center for Education Statistics, the relationship between African Americans and whites in the educational progression varies in different economic outcomes. The black-white educational gap differed in size dependent on the consistency of demonstrating necessarily the widening of the gap or the narrowing of the gap in African American cases. Business Law for contract Between Bob and Mollie †Free Samples

Whether a contract was formed between Bob and Mollie A contract is defined as a statutory agreement between two or more persons that is enforceable in the court of law . The significance of contract lies in the fact that it prises exchange of promises, which have legal enforceability (McKendrick 2014). In order to render a contract as valid, a contract must include its essential elements. In contract law , an offer is said to e terminated in the following number of ways: An offer is said to be open, if the offer does not stipulate any particular time within which the offer should be accepted, the offer should lapse after a reasonable time ((Stone and Devenney 2017). The reasonable time depends on the subject of the potential contract and is often subjected to the discretion of the judge as was held in Carr v JA Berriman [1953] HCA 31 [1953] 89 CLR 327. However, as per a general rule of the contract, even if the offeror states that the offer shall remain open for a stipulated time, the law does not bar the offeror from revoking such offer prior to its acceptance. On the facts here, Bob accepted the offer that was advertised regarding purchase of Sony Bravia OLED Televisions and gave his card to the sales manager, Mollie, of the Toshiba showroom as an acceptance to the offer. However, Mollie did not accept the card stating they were sold out. Mollie offered Bob to purchase the demonstration model TV, which would cost $2000 instead of the real offer $3500. As was observed in Smith v Hughes case, an offer was made by Mollie to Bob regarding the purchase of the TV, which was the demonstration model for the price of $2000. This further signifies that the offer was made along with a consideration, which was to be made by Bob. However, in order to render a contract as a valid contract and to be enforceable, it is essential that an offer should be made followed by a valid acceptance of such offer as was held in Crown v Clarke case. In the given scenario, a valid offer was made by Mollie to Bob but Bob was confused and required time to think about the offer. Mollie promised that she would keep the offer open until Friday provided Bob is ready to make a payment of $10 as the booking money. The tartrate salt was then reacted with potassium carbonate and 3,5-di-tert-butylsalicylaldehyde to yield (R,R)-N,N'-Bis(3,5-di-tert-butylsalicylidene)-1,2-cyclohexanediamine, which was then reacted with Mn(OAc)2*4H2O and LiCl to form Jacobsen's catalyst. The synthesized Jacobsen's catalyst was used to catalyze the epoxidation of dihydronaphthalene. Jacobsen reported that chiral manganese complexes had the ability to catalyze the asymmetric epoxidation of unfunctionalized alkenes, providing enantiomeric excesses that regularly reaching 90% and sometimes exceeding 98% . The chiral manganese complex Jacobsen utilized was [(R,R)-N,N'-Bis(3,5-di-tert-butylsalicylidene)-1,2- cyclohexanediaminato-(2-)]-manganese (III) chloride (Jacobsen's Catalyst). (R,R) Jacobsen's Catalyst Jacobsen's catalyst opens up short pathways to enantiomerically pure pharmacological and industrial products via the synthetically versatile epoxy function .   Ã‚  Ã‚  Ã‚  Ã‚  In this paper, a synthesis of Jacobsen's catalyst is performed (Scheme 1). The synthesized catalyst is then reacted with an unfunctional alkene (dihydronaphthalene) to form an epoxide that is highly enantiomerically enriched, as well as an oxidized byproduct.   Ã‚  Ã‚  Ã‚  Ã‚  Jacobsen's work is important because it presents both a reagent and a method to selectively guide an enantiomeric catalytic reaction of industrial and pharmacological importance. Experimental Section   Ã‚  Ã‚  Ã‚  Ã‚  General Protocol. 99% L-(+)- Tartaric Acid, ethanol, dihydronaphthalene and glacial acetic acid were obtained from the Aldrich Chemical Company. 1,2 diaminocyclohexane (98% mix of cis/trans isomers) and heptane were obtained from the Acros Chemical Company. Dichloromethane and potassium carbonate were obtained from the EM Science division of EM Industries, Inc. Manganese acetate was obtained from the Matheson, Coleman and Bell Manufacturing Chemists. Lithium chloride was obtained form the JT Baker Chemical Co. Refluxes were carried out using a 100 V heating mantle (Glas-Col Apparatus Co. 100 mL, 90 V) and 130 V Variac (General Radio Company). Vacuum filtrations were performed using a Cole Parmer Instrument Co. Model 7049-00 aspirator pump with a Bà ¼chner funnel. For Thin Layer Chromatography (TLC) analysis, precoated Kodak chromatogram sheets (silica gel 13181 with fluorescent indicator) were used in an ethyl acetate/hexane (1:4) eluent. TLC's were visualized using a UVP Inc. Model UVG-11 Mineralight Lamp (Short-wave UV-254 nm, 15 V, 60 Hz, 0.16 A). Masses were taken on a Mettler AE 100. Rotary evaporations were performed on a Bà ¼chi Rotovapor-R. Melting points were determined using a Mel-Temp (Laboratory Devices, USA) equipped with a Fluke 51 digital thermometer (John Fluke Manufacturing Company, Inc.). Optical rotations ([a]D) were measured on a Dr. Steeg and Renter 6mbH, Engel/VTG 10 polarimeter.

On Sept. 1, 1923 Mr. and Mrs. Pierino Marchegiano of Brockton, MA became the proud parents of a lively twelve pound baby boy. The child was named Rocco Marchegiano, but the world would one day know him as the legendary boxer Rocky Marciano. When "bambino Rocco" was 18 months of age, he contracted pneumonia. Although the infection nearly killed him, his exceptionally strong constitution enabled him to survive without impairment. As a pre-teenager, Rocky relished his mother's Italian cooking so much he bordered on being stocky. This was underscored by his relatively short but muscular arms and legs. However, even at this young age, his overall bearing suggested exceptional physical strength. Throughout his teenage years, Rocky took great advantage of living across the street from the James Edgar Playground, where he especially enjoyed playing baseball. It was during this period that he began the habit of exercising to his limit." After spending countless hours hitting and chasing after baseballs, he would often go home and do chinups and lift homemade weights until he was totally fatigued." After supper, "Rocky and his pals often spent hours pummelling a stuffed mail sack that hung from an oak tree in the Marchegiano's back yard....In hot weather, they usually finished their workouts by racing over to Saxton's Spring to get a cold drink of water." The legend of his athletic prowess began at age 15 when, as cleanup batter on the local American Legion team, he blasted a towering home run over the left field fence at James Edgar Playground.
